La Ciudad de Mobile Establece un Nuevo Toque de Queda Diurno
Mobile, Ala.- La ciudad de Mobile está imponiendo un nuevo toque de queda diurno, el cual limita a los menores de 17 años en toda la ciudad y a los menores de 18, en el centro, a reunirse y vagar en lugares públicos y las calles durante el dia.
   Los oficiales de la ciudad dicen que los agentes policiacos no recogerán rutinariamente a los jóvenes sólo por imponer el decreto del toque de queda, pero si se les da causa probable para imponerla y la discreción cuando encuentren comportamiento sospechoso o peligroso lo harán.  si son menores de 17 (o menores de 18 en el centro) y el porpósito de estar ahi no está exento el joven será aconsejado del toque de queda y mandado a regresar a casa.  Si el joven obedece, no se tomará ninguna acción.  Si el joven es detenido por la policia y no tiene un propósito definido o autorización de sus padres, el padre, guardián o adulto autorizado será llamado.  El juvenil les será entregado con sólo una advertencia. Si la desobediencia al toque de queda persiste y ningún adulto es localizado, el joven será llevado al Curfew Assesment Center (Centro de Evaluación del Toque de queda) en St. Anthony/Broad Streets (por no más de 3 horas) donde el departamento de Recursos Humanos requiere y un padre, guardián o empleado sera citado.  Los jóvenes que cometan actos criminales serán transportados por la policia a Strickland Youth Center.
   Una violación del toquede queda es una violación legal castigada por una  multa de $100 por la primer offensa y hasta $500 por la segunda ofensa (y todas las subsiguientes violaciones) en un año o por encarcelamiento hasta por 6 meses, o multa y cárcel.  El padre, el guardián o el adulto autorizado son responsables por la multa y encarcelamiento.  Un dueño u operador de un establecimiento comete una ofensa si él o ella, sabiéndolo, permiten a un juvenil permanecer en el establecimiento durante las horas del toque de queda.  Cualquier dueño o un operador de un establecimiento no exento del toque de queda, y después de repetidas admoniciones verbales, estará sujeto a una multa de $100 por la primer offensa y hasta $500 por la segunda ( y subsiguientes) ofensas.
   Los jóvenes que tienen que trabajar después de las horas del toquede queda están exentos de esta ordenanza.  Sin embargo,se espera que vayan directamente a sus hogares sin hacer paradas cuando el turno de trabajo termina.  La ordenanza del toque de queda dispensa a jóvenes atendiendo actividades tales como cine nocturno, la fiesta de la escuela (prom) eventos deportivos, eventos relacionados con la escuelay religiosos, etc. con la autorización del padre o guardián o acompañado por un adulto autorizado.
     Los dueños de negocios no exentos del toque de queda están obligados a obervar el toque de queda dentro de lo razonable.  Un dueño de negocio puede ser legalmente responsable por proveer un local, a sabiendas, para que un grupo de jóvenes rebeldes, se reúna durante las horas del toque de queda y se les pide que soporten el toque de queda no permitiendo que su establecimiento o propiedad se  comnierta un lugar de reunión para grupos juveniles que potencialmente podrian causar prpblemas.  Hay nalgunas excepciones en el mandato que  permitiria juveniles en el local.  Más información sobre el nuevo decreto está disponible en Curfew Assesment Center (251) 208-6141 o en buck@cityofmobile.org.

El toque de queda limita a los jóvenes menores de 17 años para el toque de queda en toda la ciudad y a los menores de 18 en el centro, a reunirse y vagar en lugares públicos y calles durante las horas siguientes:

• Cuando esté acompañado por otro adulto autorizado por el padre o guardián para un propósito específico
• Cuando este haciendo un mandado aprobado por el padre, guardián o adulto autorizado
• Para ir y venir al trabajo
• En caso de emergencia
• Para el Prom (baile), eventos deportivos, actividades religiosas y escolares todas aprobadas por el padre, guardián o adulto autorizado
• En la propiedad/acera donde el menor reside. Si el vecino no registra quejas por la presencia del menor.

City of Mobile Initiates New Daytime Curfew
Mobile, Ala. – The City of Mobile is enforcing a new daytime curfew, which restricts juveniles under the age of 17 citywide curfew and under 18 for the downtown curfew from gathering and roaming in public places and streets during daytime hours.  
     City officials say that police officers would not routinely gather up juveniles for the sake of enforcing the curfew ordinance, but will be given “probable cause” for enforcement and the discretion tool when encountering suspicious or dangerous behavior. If they are under 17 (or under 18 in downtown) and the purpose for being out is not exempt, the juvenile would be advised of the curfew and instructed to return home. If the juvenile complies, no action is taken. If the juvenile is stopped by Police with no defined purpose or parental authorization, the parent, guardian or authorized adult is called. The juvenile is then released to them with only a verbal warning. If non-compliance to the curfew persist and no adult is located, the juvenile is either taken to the Curfew Assessment Center at St. Anthony/Broad streets (for no more than 3 hours) where the Alabama Department of Human Resources is requested, and a parent, guardian or employer will be cited. Juveniles who commit criminal acts will be transported by the police to Strickland Youth Center.
     A curfew violation would be a status violation punishable by a fine of a $100 for the first offense and up to $500 for the second offense (and all subsequent violations) within one year or by imprisonment of up to six months; or both fine and imprisonment. The parent, guardian or authorized adult are liable for the fine and imprisonment. An owner or operator of an establishment commits an offense if he or she knowingly allows a juvenile to remain on the premises of the establishment within curfew hours. Any owner or operator of an establishment not exempted under the curfew, after repeated verbal warnings, will be subject to a $100 fine for the first offense and up to $500 for the second (and subsequent) offenses.
     Juveniles required to work past curfew hours are exempt from the ordinance. However, they are expected to return directly home without making any stops once a work shift ends
The curfew ordinance exempts juveniles attending such activities as the late night movies, prom, sporting events, school and religion-related events, etc. with the authorization of a parent or guardian or accompanied by an authorized adult.
     Business owners not exempted from the curfew are obligated to reasonably uphold the curfew. A business owner could be held legally accountable for knowingly providing a location for an unruly group of juveniles to gather during curfew hours, and are asked to support the curfew by not allowing their establishment or property to become a gathering place for groups of juveniles who potentially could cause problems. There are some exemptions in the curfew ordinance that would allow juveniles on the premises.

• When on the property/sidewalk where the minor lives. Next door neighbor’s home if no complaints registered due to minor’s presence
