Federal Court Rules Florida’s Tuition Policy for Children of Undocumented Parents Unconstitutional The Southern Poverty Law Center (SPLC) filed a federal class action lawsuit in October 2011 challenging Florida’s tuition policies that treat students who are U.S. citizens and residents of Florida as non-residents solely because their parents are undocumented residents. The federal court’s decision to end this discriminatory tuition policy is a victory for the young plaintiffs who have been deprived equal access to a quality college education. The court’s ruling states that the Florida’s tuition policy is a clear Constitutional violation. “Today is a great day for these young people across the state of Florida who simply wanted the opportunity to get an education and, with that, a chance for the American Dream,” said Jerri Katzerman, SPLC Deputy Legal Director. “This policy, which was blatantly unconstitutional, will no longer be a roadblock for these young students who may very well be the state’s leaders of tomorrow.” While federal and states laws guarantee every citizen’s right to receive a primary education, access to a post-secondary education is also a critical component of attaining the American dream. |
